Terms of Service

These terms govern your access to and use of Acumin (“Acumin”, “we”, “us”), a product of Acumin Intelligence (Pty) Ltd, a company registered in South Africa (registration number 2026/495251/07). By creating an account or using the platform you agree to them. We've kept them plain rather than dense, and we'll post any changes here as the product evolves.

1. What Acumin does

Acumin reads public content and the data you choose to connect, then produces decision support — Signals, Concept Reads, Creative Briefs, Launch Playbooks, Content Analysis, Pre-Flight reads, and always-on intelligence surfaces (Competitor Watch, Category Trend Radar, Rising Signal alerts, Performance Pulse, Share of Voice, Audience Sentiment) — to help you decide what content to make next.

Acumin's analytics integrations are read-only — it never posts original content, schedules, advertises, likes, follows, edits, or deletes anything on any account you connect or analyse. The one exception is engagement you initiate: you can reply to comments and direct messages from inside Acumin, and we send only the message you write, only when you click send. Nothing is ever sent automatically.

Our outputs are evidence-based observations and AI-generated analysis of observed data — not guarantees of results. Every figure traces to the underlying data; we don't invent numbers or promise performance, reach, virality, or revenue.

2. Eligibility and your account

You must be at least 18 and able to enter a binding contract. If you use Acumin on behalf of a business, you confirm you're authorised to bind it to these terms.

You're responsible for activity under your account, for keeping your details accurate, and for keeping your login secure. Tell us promptly at privacy@acumin.ai if you suspect unauthorised access.

3. Acceptable use

Use Acumin lawfully and as intended. You must not: scrape, overload, probe, or disrupt the service; reverse-engineer or copy it to build a competing product; resell or sublicense it without our written permission; use it to infringe anyone's rights, to breach a third-party platform's terms, or to process data you have no right to; upload content you don't own or have permission to use (for example, videos you submit to Pre-Flight); or use Acumin's reply and messaging features to send spam, harassment, or any message that breaches a platform's rules.

4. Connected accounts and third-party platforms

When you connect or name an account, you authorise us to access the relevant data to provide the service: read-only for analytics, plus — where you choose to use them — the publishing and engagement features. Those write to your connected accounts only at your instruction: a post you wrote and approved inside Acumin, sent at the time you chose; or the comment and direct-message replies you type, sent when you click send. We never publish anything you have not approved, never post on your behalf without that approval, and never send anything automatically. You are responsible for the content you publish and the replies you send through Acumin, including that you hold the rights to it and that it complies with each platform's own rules. How we handle your data is described in our Privacy Policy.

Acumin integrates with third-party platforms — including Google/YouTube, Meta (Instagram and Facebook), and TikTok. Your use of those integrations is also subject to each platform's own terms, and you're responsible for complying with them.

YouTube: Acumin uses YouTube API Services. By using the YouTube-powered features you agree to the YouTube Terms of Service (https://www.youtube.com/t/terms), and you acknowledge that Google's Privacy Policy (https://policies.google.com/privacy) applies to data accessed via the YouTube API.

Meta: Acumin's use of Instagram, Facebook, and Meta advertising data complies with the Meta Platform Terms. TikTok: Acumin's use of TikTok data complies with the TikTok Developer Terms of Service.

5. Subscriptions, fees and billing

Paid plans are capacity tiers described on our pricing page. Prices are shown and charged in US dollars through our billing provider, Dodo Payments (Merchant of Record). Dodo Payments handles tax, invoicing, and payment processing on our behalf.

Subscriptions renew automatically each billing period (monthly or yearly) until cancelled. You can cancel at any time from your billing settings — cancellation stops future renewals, and your plan stays active until the end of the current paid period.

Except where the law requires otherwise, fees are non-refundable and we don't pro-rate partial periods. If we change prices, we'll give reasonable notice and the new price applies from your next renewal. You're responsible for any taxes on your purchase, and failed or reversed payments may lead to suspension or downgrade of your plan.

6. Outputs and how to use them

Briefs, reads, playbooks, and other outputs are provided for your decision-making. They describe what the observed data shows and are advisory only — they are not financial, legal, investment, or other professional advice, and they are not a guarantee of any outcome. You decide whether and how to act on them, and you're responsible for those decisions and for the content you ultimately publish.

7. Intellectual property

We own the Acumin platform, software, models, and brand. You keep ownership of the content and data you bring. We grant you a non-exclusive licence to use the outputs we generate for you in your own business, and you grant us the licence needed to process your inputs and connected data to provide and improve the service. We don't sell your data, and we don't use your private data to train third-party AI models.

Typefaces used in Acumin and in the files it generates are licensed under the SIL Open Font License 1.1: Figtree, Inter, and Noto Sans, together with the display faces offered in Thumbnails (Anton, Bebas Neue, Archivo Black, Jost, Montserrat, Poppins, Mulish, Oswald, EB Garamond, Playfair Display, and Cinzel).

9. Availability, previews and changes

We work to keep Acumin available and accurate, but the service is provided on an “as available” basis and may change. Some features may be offered as previews or beta and can change or be withdrawn. We may update the service or these terms as the product develops; material changes are reflected by the “last updated” date above and, where significant, notified by email.

10. Suspension and termination

You can stop using Acumin and cancel at any time. We may suspend or terminate access if you breach these terms, misuse the service, or where required by law. On termination your right to use the service ends; how we handle your data on closure is covered by our Privacy Policy and Data Deletion page.

11. Disclaimers

To the fullest extent permitted by law, Acumin is provided “as is” and “as available” without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or non-infringement. We don't warrant that outputs will be error-free or that the service will be uninterrupted.

12. Limitation of liability

To the fullest extent permitted by law, we aren't liable for indirect, incidental, special, or consequential losses, or for lost profits, revenue, data, or business outcomes arising from decisions you make using the outputs. Our total liability for any claim relating to the service is limited to the amount you paid us in the three months before the claim. Nothing in these terms excludes liability that cannot lawfully be excluded.

13. Indemnity

You agree to indemnify and hold us harmless against claims, losses, and costs arising from your misuse of the service, your breach of these terms, or content or data you provide or publish that infringes a third party's rights or breaches a platform's terms.

14. Governing law

These terms are governed by the laws of South Africa, and the courts of South Africa have jurisdiction — without affecting any mandatory consumer-protection rights you have where you live.
